2008 Consignment Contract

Appointment:   (Under no circumstances will items be looked at without an appointment.  You will be turned away.) You must make an appointment to bring in items for buy-out/consignment.  You will drop off your items for consideration.  Once I decide what will go on the sales floor, you will be called to come get what I haven’t taken. *Please note not all of your items will always be selected.  Only the best meeting my criteria will be selected.  Criteria changes from season to season as well as week to week. Refer to guidelines for more information.

Consignment Period: Your Maternity, Children’s Clothing, Women's Clothing, Furniture, Baby Gear, Books, Videos and Toys, will be consigned for 90 days.  Payment to the consignor is 50% of the retail selling price.  Payout is at the end of your 90 day consignment period OR if you decide to keep your items longer it will be at the end of the extended period.  A sale report of your items will accompany your check.  This will be an itemized list of what has sold and for how much.  Please note that items brought in may be stocked at either one of our two stores, both of our stores or just one of our stores.  All items accepted may not go to the floor at once.  Your items may be filtered out to the floor over your 90 day consignment period.

Pricing: Pricing of all items is left solely to Lynn Saponaro, owner of the store.  Pricing is determined by the original retail selling price of the item, the condition it’s in and the brand/popularity of the item. Owner is aware that some items may have come from her store or other outlet stores and prices are determined accordingly. Prices may be reduced at any time during the consignment period in order to facilitate the sale of your items.  Owner will make a concerted effort to sell your items but makes no guarantee that the store will be able to sell any of your items while on consignment. Pricing lists will not be accepted by vendors/consignors.  Pricing is up to the store owner.  Pricing is usually 1/3 of your retail cost with consideration to the item(s) age, condition & brand name.

BATTERIES:

Toys or baby gear brought to the store without batteries will be taken, however, if the store needs to supply batteries to get your item in working order, your account will be charged for the batteries needed to operate your items.

Reductions:  Price reductions are at the discretion of the store owner and determined by her expertise.  To keep your items selling in the store, items may be reduced after 30 days. Your items are subject to reductions during in store sales at any time during your consignment period.

Liability:  Mommy-n-Me Children’s Resale Boutique will not be held accountable for loss due to fire, theft, vandalism, damages or other unusual circumstances.  We take exceptional care of the items you consign, however merchandise is left at your own risk.

Disposition of Unsold Items: You will be notified by phone or email when your items are ready for pick up. Vendors/Consignors are responsible for picking up unsold or discarded (for buyouts) items within 3 days of our phone call for pick up.  After that, they become the property of the store and are donated.  Bins of clothing not picked up after 3 days will also be donated.

Your items will be pulled off the floor and gathered together.  You will be handed any items that didn’t sell.  You will also be required to sign your final pick up contract which we can email to you upon request. 

Buyout:

If you choose to have your items bought outright at 30% of my retail price, you will receive an itemized list of what I accepted and what it will be tagged at.  The sheet will also show your total purchase price for me to buy the items selected.  Items not selected will be handed back to you.  Once items are paid for by the owner to the vendor, the items become the possession of Mommy-n-Me Children’s Boutique to sell at her two store locations.

Vendor/Consignment Contract

By signing this contract, I have read & agreed to all the terms in the buy-out/consignment contract and guidelines and certify that I own the items brought in for consignment/buyout with all rights to sell such items. I understand that Mommy-n-Me Children’s Resale Boutique will make every effort to sell my items, but isn’t guaranteed.  I also agree that once pricing is given and agreed to for buyouts the items brought become the property of Mommy-n-Me Children’s Resale Boutique to sell.  I also understand that my items are on consignment for 90 days & I agree to all parts of the consignment contract listed above.
